Introduction

These Terms of Service ("Terms") govern your access to and use of thepromptyard.com (the "platform," "we," "us," or "our"). By accessing or using the platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the platform.

Beta Disclaimer

The platform is currently provided in a public beta state. You acknowledge and agree that the platform may contain bugs, errors, or other limitations, and that features may change, be removed, or be discontinued at any time without notice. Data may be lost or reset during this period.

The platform is provided for testing and evaluation purposes, and you should not rely on it as your sole means of storing important content.

Eligibility

You represent and warrant that you are at least thirteen (13) years of age. If you are under eighteen (18) years of age, you further represent that you have obtained the consent of a parent or legal guardian to use the platform.

Accounts

You are responsible for maintaining the confidentiality and security of your account credentials and for all activities that occur under your account.

User Content that you designate as "public" or "unlisted" may be accessible to other users and may be viewed, copied, forked, remixed, or otherwise used within the platform in accordance with its functionality.

Private Content

User Content that you designate as "private" will not be made available to other users, except as necessary for system operation, security, or legal compliance.

Prohibited Conduct

You agree not to use the platform to upload, post, transmit, or otherwise make available any content or engage in any conduct that:

  • Violates any applicable law or regulation
  • Infringes upon the intellectual property or other rights of any third party
  • Contains confidential, proprietary, or trade secret information without authorization
  • Contains malicious code, including viruses, malware, or other harmful components
  • Is fraudulent, deceptive, or misleading
  • Harasses, threatens, or abuses any individual or group
  • Is intended to exploit, manipulate, or interfere with third-party systems, including AI systems, in violation of their terms

We reserve the right to remove content and suspend or terminate accounts that violate these provisions.

AI Services and Outputs

The platform may enable interaction with third-party artificial intelligence systems. You acknowledge and agree that:

  • AI-generated outputs may be inaccurate, incomplete, biased, or otherwise inappropriate
  • We do not control and are not responsible for the outputs generated by such systems
  • You are solely responsible for evaluating and using any outputs generated

You further agree to comply with the terms and conditions of any third-party AI providers you use in connection with the platform.

API Keys

If you provide API keys for use with third-party services:

  • You are solely responsible for all usage and associated costs incurred
  • You are responsible for maintaining the confidentiality and security of such keys
  • You must promptly revoke and replace any compromised keys

While we implement reasonable safeguards for storage, you acknowledge that use of such features is at your own risk.

Intellectual Property

All rights, title, and interest in and to the platform, including but not limited to its software, design, features, and branding, are and shall remain the exclusive property of thepromptyard.com and its licensors.

You may not copy, modify, distribute, or create derivative works based on the platform except as expressly permitted.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THEPROMPTYARD.COM OR ITS OPERATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE PLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD $50).

Indemnification

You agree to defend, indemnify, and hold harmless thepromptyard.com and its operators, affiliates, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the platform
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

Termination

We reserve the right, in our sole discretion, to suspend or terminate your access to the platform at any time, with or without notice and for any reason.

Upon termination, your right to access and use the platform will immediately cease.

Data handling following termination is governed by our Privacy Policy.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the platform operates, without regard to conflict of law principles.

Changes to These Terms

We reserve the right to modify or update these Terms at any time. Continued use of the platform following the posting of updated Terms constitutes your acceptance of such changes.
